CONCLUSIONS

The policy of hostility, blockade and aggressions by successive United States administrations against the free determination and sovereignty of the Cuban nation –which comprises the unjust anti-Cuban exercise on human rights— did not start with the triumph of the Cuban Revolution in 1959 or with the proclamation of its socialist nature in 1961. These have been permanent lines of the behavior of the Washington circles of power toward Cuba for more than 150 years.

The economic, commercial and financial blockade of the United States against the Cuban people is one of the most important mass, flagrant and systematic violations of the Cuban people’s human rights stemming from the policy of hostility against the Cuban nation, but not the only one.

The Cuban people have been the victims of mercenary invasions; of biological, radio and television aggressions; of the external encouragement of illegal and violent emigration; of assassination attempts against their main leaders; and of sabotage and terrorist acts that have caused direct damage to economic and social targets in the country for more than 54 billion dollars, the proven death of 3,478 people and the permanent disability of another 2,099 Cubans.

The resolution against Cuba imposed every year upon the Human Rights Commission was the result of political manipulation and blackmail maneuvers of the United States authorities.

The Bush Administration’s aggressive actions, hostile measures, provocations and threatening declarations against Cuba have been severely strengthened over the last few years. Those that joined in the anti-Cuban exercise in the extinct Commission on Human Rights behaved as accomplices in the unjust fabrication of the pretext resorted to by the current tenants of the White House in order to promote a “change of regime” in Cuba, which would only be possible after a mass invasion and military occupation and the literal genocide of the Cuban people.

One cannot judge the Cuban reality and the need to prosecute and severely sanction mercenary elements at the service of the superpower’s anti-Cuban and annexationist plans –who have been prosecuted by strictly abiding by the law and are treated with the most exemplary respect for their human dignity–, ignoring the circumstances of the unprecedented worsening of the United States hostility to the Cuban people and the threats it poses for their very existence as an independent nation.

The media campaign orchestrated by Washington with the objective of presenting its mercenaries sanctioned in Cuba as alleged “journalists, trade-unionists and peaceful political opponents” is humiliating for the fair cause of human rights and outrageously deceitful. None of them was sentenced for expressing opinions or ideas, or for the exercise of some of the rights recognized in the Universal Declaration of Human Rights. They are serving their respective terms in the conditions of dignity, attention and respect that are guaranteed for all Cubans and foreigners that undergo correctional confinement in the country.

Cuba has cooperated and will continue to cooperate fully with all the non discriminatory and universally applied procedures and mechanisms of the United Nations system in the area of human rights. However, it cannot acknowledge or cooperate with the implementation of the spurious anti-Cuban resolutions that the superpower imposed upon the extinct Commission, from which the mandate of the so-called “Personal Representative” of the High Commissioner for Cuba derives. As happened in the past with the so-called Special Rapporteur, this new procedure will disappear one day in which justice will make its way again, without the person that holds such illegitimate mandate being able to ever exercise it in the Cuban territory.

The Cuban people’s resistance and decision to fight onward till victory are continually put to formidable tests. Five young antiterrorist fighters and defenders of the human rights of the Cuban people, remain arbitrarily imprisoned in the United States and, along with their relatives, are submitted to the cruelest forms of psychological torture. The Cuban people –with the solidarity of many honest people from all over the world, including from the United States— demand their release and return to their Homeland as their right.

Despite the inherited conditions of underdevelopment and the strong blockade that the United States Government imposes upon the Cuban people, they have been able to advance significantly on their revolutionary transformation with the objective of building an increasingly just and equal society that guarantees broad possibilities for the exercise of the democratic participation of all citizens. The institutions and components of a State grounded on the power of the vast masses of workers, intellectuals, professionals and artists, work together with a numerous and active civil society, allowing every Cuban man and woman to have an actual and systematic participation in the decisions that affect their present and will determine their future.

Cuba hopes that justice and truth will prevail and that the members of the Council will keep the United States from activating its illegitimate and useless anti-Cuban routine in the work of the new human rights body. Cuba is ready to continue to move on in international cooperation and genuine dialogue in the area of human rights. However, if the path of confrontation should be imposed, Cuba will continue to battle onward till victory forever.

The Cuban people will continue to fight for the defense of their right to free determination, to development, to peace and to a fairer, democratic and equal world order, in which the goal of All Human Rights for All can finally come true. They are ready to put forth their talent, their sweat and their blood for this just vindication if necessary.
