Cuban Anti-terrorist Awaits Habeas Corpus in the USA.
 
CUBA, August 23, 2011.- Washington denied Cuban anti-terrorist Gerardo Hernandez the right to be heard in court shortly before the period to present his writ of Habeas Corpus expired.

On April 25, district attorney Caroline Heck Miller in the name of the United States government asked the federal court of Miami to reject a special appeal by Hernandez, who was unjustly sentenced to two life imprisonments.

Hernandez remains in prison since 1998, along with Antonio Guerrero, Ramón Labañino, Fernando González and René González, for warning Cuban authorities about terrorist plans organized in Florida against their country.

The writ of habeas corpus is requested by a defendant when he thinks his fundamental and constitutional rights were violated, then he goes to court to review his sentence, said José Pertierra, an expert on immigration issues in Washington D.C.

Hernandez, who was denied the right to a re-sentence hearing in late 2009. Three of his partners had their previous sentences reduced by this means, and Hernandez asked the court to determine whether he has a right to an effective representation by his lawyers.

Gerardo Hernandez faces two life imprisonments plus a 15-year sentence for conspiracy to commit espionage and murder; the latter was related to the case of two aircraft of the Brothers to the Rescue terrorist group shot down in Cuban territory on February 24, 1996.
