CUBA, February 5, 2007.- The Cuban government denounced on Monday the use by United States of a new legal subterfuge to not accuse Luis Posada Carriles of terrorist and murderer, states an official note published in this capital. According to the Cuban Foreign Affairs Ministry (MINREX), on February 1, Washington authorities should have supported charges that impede acceptance of the appeal presented by that criminal s defense attorney. However, the source states, on January 31, the US General Attorney s office rejected the charges for being inappropriate, saying that Posada is not under the custody of the Internal Security Department. Posada Carriles is the mastermind of several terrorist actions against the island, like the explosion in mid air of a Cuban airplane in 1976 with 73 passengers aboard, and a chain of bomb attacks to Havana hotels in 1997, which killed an Italian tourist. Despite evidence of his violent actions, Posada Carriles has been tried in that northern country for migratory crimes, denying his extradition request by Venezuela to try him in that territory. Cuba says crimes against humanity were committed by this Cuban-origin individual, who was member of the Central Intelligence Agency, to destroy the Cuban Revolution. The note states that Posada Carriles has been granted impunity, even when US entities recognize that "he has a criminal record and has been involved with people and organizations that promote and use terrorist violence."
