Letter of Irish MPs to US Attorney General

Dublin, Oct 4 (Prensa Latina) Some 49 members of the Irish Parliament, including eight senators, have sent a letter to the US Attorney General, Alberto Gonzalez, demanding the release and exoneration of the Cuban Five.

The legislators stress that as members of "Dáil Éireann, call on the relevant authorities in the United States to release the five men immediately and to cooperate to ensure the full and timely implementation of the decision made by the Judges of the Eleventh Circuit Court of Appeals in Atlanta."

Dear Mr. Gonzales,

The United States Eleventh Circuit Court of Appeals in Atlanta has unanimously declared null and void the decision of a Miami court to jail Gerardo Hernandez Nordelo, Rene Gonzalez Sehwerert, Ramon Labañino Salazar, Antonio Guerrero Rodriguez and Fernando Gonzalez Llort, and has ordered a retrial on the grounds that, due to political pressures and manipulations surrounding the Miami process, they were not given a fair and impartial trial.

The prison sentences of the Five Cubans have also been declared illegal by the Working Group on Arbitrary Detentions of the United Nations Commission on Human Rights.

For the past seven years, these five men have been in maximum security prisons, incommunicado in isolated cells for long periods of time and two of them have been denied the right to receive visits from their wives and one visits from his infant daughter, in breach of U.S. and international law and of their human rights.

At this time, in spite of the reversal of their convictions by the Eleventh Circuit Court of Appeals and the expiry of the 21 days customary deadline for the submission of appeals, the five men continue to be subjected to an especially harsh prison regime, incompatible with their legal status, while the prosecution is returning to its historical pattern of delay in the implementation of the appeal court decision.

This can only inflict more pain on the men and their families, and is entirely without legal justification.

WE, members of Dáil Éireann, call on the relevant authorities in the United States to release the five men immediately and to cooperate to ensure the full and timely implementation of the decision made by the Judges of the Eleventh Circuit Court of Appeals in Atlanta.
